This Policy states how SITYO collects, uses, maintains, updates, removes and discloses personal data about users of our SITYO Shall I Take Your Order App (the "App") and others having connections to SITYO. This Policy applies to this website ("Site"), loading and use of the App and other SITYO activities.

We try to respect your privacy. This is a policy, stating what we try to do. It is not a contract obligation on our part. However, pursuant to this policy you grant certain consents, licenses and exclusions and limitations of liability.

Please review this policy. If there is any part you do not agree with, or if you do not think this policy provides enough protection for you, this policy tells you how to tell us. You can also exit this Site and not stay or visit it and not load or use the App. If there is information you do not consent to our receipt, collection, use of or sharing, you can tell us and can opt-out. (Some information is collected from your current visit and letting us know will generate some information we will then have).

This Policy is addressed to visitors to this Site, those who load our App onto devices, users of the App, and recipients of communications, electronic or otherwise, that contain or refer to this Policy. This Policy is addressed to restaurants and other venues, suppliers, personnel and others having connections to SITYO.

We obtain information several ways. We try to limit information we intentionally gather to only what is necessary for the purposes we collect the information for. Here are types of information we collect, and where it comes to us from.

Voluntary disclosure. We collect information you provide, such as your name, address, phone, email address. We obtain this from you. We could obtain information about you from others such as if someone tells us something about you.

We collect information we receive from your visit to this Site. When you visit or use our Site, we obtain data about you, your device, date and time of visit, browser, IP address, and operating system, internet service provider, websites from which you accessed our Site, what you do in the visit, pages you visit, order of pages, time on each page, and other information. These are only examples. Technology may let us collect and store other data about your visit, use and activities.

We collect information when you use the App. Each time you access the App, we collect date and time you installed the App, date and time you last used the App, what version of the App you are using, information about the device you use, operating system type and version number, manufacturer and model, device ID, push tokens, browser type, screen resolution, IP address, website you visited before visiting our Site and other information about the device, pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and length of access. When you make use of the App for a transaction, we collect information like items purchased, prices and total.

We could collect other information not listed above, for example, metadata, and possibly new kinds of information have been derived since this Policy was written or will be derived in the future, that we collect or will collect. Personnel could receive information from sources not categorized above, like being told information, seeing or hearing information on the internet or other media, receiving unsolicited information, learning something in a discussion and noting it for reference, or any other ways information is received, noted and saved.

In the past 12 months we collected these kinds of personal information from personnel and applicants for employment with SITYO: names, alternative names used, email address, postal/mailing address, phone number, age, employment history, education, social security number, immigration/citizenship status, military service, and any other information as might be requested or provided in an employment application, interview and/or checking references.

5. Sources of Information

As noted above, sources of information from which we collect personal information are persons who provide us information about themselves, this Site, the App, information stored in devices that the App accesses, employment applications, interviews, references and potentially any other means of communication. Thus, other sources could include information received in news and advertising media (broadcast, print, internet, social media), email and text messaging programs, and information received in oral and written communications with others.

6. Purposes for Collecting and How We Use Your Information

Personal information. Information you give us, we use to identify you and provide you information about the App and usage of the App. We use this information also for the operation of the App to facilitate transactions using the App. We use your IP address to help identify you and gather information for statistical purposes. We may use contact information to provide information on products and services.

Analyses. We use information about visits to our site to do statistical analyses of user behavior and characteristics and measure interest in and use of areas of the Site. We could in the future use the information in ways or to do things we do not currently do or did not do when we obtained the information.

Merger or acquisition. If we merge, acquire or are acquired, or explore doing so, other participant(s) in the transaction and their advisors will have access to information we have. The successor entity could have different policies or could choose to modify these policies.

We do not knowingly sell, trade or transfer information to others outside of SITYO service providers or outside the scope described above. But new ways of information gathering and sharing of information and new circumstances may occur. You should not take anything in this policy as assurance that information is not or will not be shared in other ways.

7. How Long We Keep Information

We keep your personal data as long as we believe it may be useful. As a company providing use of an App, which users have the option to use at any time, even after periods of nonuse, information has potential use for a long time. It may be useful even after a lapse. So we may keep information potentially indefinitely.

8. Deletion Request.

You can tell us to delete information about you. If you tell us to delete information about you, we will try to do that within 45 days after getting your instruction. However, we will keep your name, email address and postal mailing address on a list to help us try to avoid again saving information about you and sending you marketing. You may ask to not receive communications, for us to not sell information about you, and/or remove information we have about you. You can ask us to block our system from receiving information about you, or delete prior information so that, regarding you, we begin anew as to information we then receive. You can also use the email or mail address or phone number to ask us to remove information about you, or direct us to not sell information about you.

As a result of your request, we will still have some information about you, for example, our system keeps a record that you asked us to remove information and not send email to you. If we made and stored backup records, information about you will remain in those stored records.

12. Security

We try to protect personal information. For example, this site and our system have security measures, seeking to reduce risks of loss, misuse and alteration of information under our control. Our measures are updated and tested from time to time. We do not claim to have the most advanced or best possible or perfect security measures. No measures provide 100% certainty against all risks. Inadvertent disclosure, technology changes, hackers, dishonesty by persons with access, human error and weaknesses in procedures are examples why it is impossible for us, or anyone, to guarantee your information cannot be accessed or disclosed. WE AND OUR OWNER(S), MANAGERS, OFFICERS, EMPLOYEES, PARENT COMPANIES, AFFILIATES AND REPRESENTATIVES SHALL NOT BE LIABLE FOR LOSS, INJURY OR DAMAGE ARISING FROM OR RELATING TO DISCLOSURE OF YOUR INFORMATION. Please do not disclose to us any information that is so confidential or personal that its release would cause you injury.

13. Cookies and Targeted Advertising

Our website may use "cookies," seeking to enhance user experience. This may result in placing cookies on a user's device, for recordkeeping and sometimes to track information about them. A user may set their web browser to refuse cookies or alert you when cookies are sent. This choice may result in some parts of the website not functioning as well as if cookies are permitted.

14. Personal Information of Children

The App that SITYO provides has use in reviewing menus, ordering, requesting service, paying the bill and tipping workers at participating restaurants. Our App can benefit persons of suitable age to make purchases at restaurants, but our communications, sales and information gathering activities are not directed at persons/children under the age of 13. SITYO does not seek through the Site to gather personal data from or about persons under this age. SITYO does not sell personal information of persons under this age without affirmative authorization.

15. Linked Internet Sites

This Policy applies only to information collected by us through this Site or otherwise. Other Internet sites which link to this Site have their own privacy and other policies or practices that differ from this Policy. WE ARE NOT RESPONSIBLE FOR POLICIES, PRACTICES OR CONTENT OF OTHER SITES. Being aware when you leave this Site and reading the privacy statements and other policies of each website you visit are your responsibility.

16. Information Sales and Transfers

We do not sell your personal information, in the ordinary sense of selling names and addresses to others unrelated to us for money so they can advertise or solicit you to buy goods or services.

A California law called the California Consumer Privacy Act ("CCPA"), defines "sell" in relation to personal information, more broadly, to include sell, rent, release, disclose, disseminate, make available, transfer or otherwise communicate that information orally, in writing or electronically to another business for money or other consideration. Understood this way, we could be considered to have sold information to some categories of third parties. One category is restaurants that participate in use of the App. Another category is fulfillment companies we contract with to print and send printed advertising and marketing through postal mail and email, for example, about our products. A third category is internet marketing companies that conduct advertising and marketing for us over the internet through search engines and social media. (We mention this for informational purposes; SITYO believes we are not currently subject to requirements of the CCPA).

The categories of information we provided to these third parties in the past 12 months are: alternative names used, unique personal identifier and/or online identifier, IP address, email address, postal/mailing address, device used, browser used, operating system, education, employment, age, services and products considered, purchased and/or obtained, purchase and use (consuming) history and tendency, browsing history, search history, path of travel on our website, visitor geolocation, electronic information, profile, particular person preference, characteristics, psychologic trends, predisposition, behavior and attitude, photographs and any other kinds of information this policy describes as information we collect.

We do not sell personal information of persons under age 13 under any of the above definitions.

We may transfer information we collect about you to recipients in countries other than the country where the information was collected. Those countries may not have the same data protection laws as the country where you initially provided the information. We may now or hereafter transfer information to recipients in other countries. If so, we will seek to protect the information as described in this Policy and to comply with legal requirements providing adequate protection for transfer of information to recipients in those countries. By submitting information to us you consent to transfer of your information to countries that may not have the same data protection laws as the country in which you initially provided us information. If you do not want your information transferred as stated here, you should not submit information to us.

17. Automated Decision Making

SITYO does not use automated decision-making unless it is necessary for entering into, or performance of, a contract between the individual and SITYO, or permitted or required by law, or based on the individual's express consent.

Automated decision-making refers to decisions that produce legal effects concerning an individual or significantly affect an individual and are based solely on automated processing (no human intervention) of personal data. SITYO intends to implement suitable measures to safeguard individual rights and freedoms and legitimate interests when automated decision-making is used.

18. Compliance With Privacy and Data Protection Laws

SITYO seeks to collect and use personal data lawfully. We seek to comply voluntarily with some aspects of the CCPA, though we understand this Act does not apply to us at this time. We seek to comply with all laws we are subject to, that govern our collection and use of personal data.

19. California Residents Privacy Rights

The California Consumer Privacy Act requires companies that are subject to the law, to provide transparency regarding data practices and let you learn information about information such companies collect, use, disclose, sell, rent, release, disseminate, make available, transfer or share orally, in writing, electronically or other ways, and about our sources and purposes for collecting and sharing information. Because we try to voluntarily comply, though not required to do so, we let you request, among other things, access to and deletion of personal information. We do not, by this effort, undertake to obligate ourself under this law.

California Civil Code Section 1798.120 may let a California resident opt-out of the sale of personal information to third parties. This policy describes circumstances in which we share your information with third parties. This policy also provides you certain controls and choices regarding our collection, use, and sharing of your information.

California Civil Code Sections 1798.100 and 1798.105 let a California resident make requests to access categories and items of personal information about you, and request deletion of personal information about you. You may make such requests up to two times in any twelve (12) months.

If you are a California resident, California Civil Code Section 1798.83 lets you request information regarding disclosure of your personal information by SITYO to third parties for the third parties' direct marketing purposes.

Only you, or a person you authorize to act on your behalf, may make a request regarding your personal information. For access and deletion, your request must be verifiable for us to fulfill the request. Verifying your request will require you to provide information for us to reasonably verify that you are the person about whom we collected personal information, or a person authorized to act on your behalf (e.g., prior transactions of person to whom request relates).

We will use the personal information you provide in a verifiable request only to verify your request. We cannot respond to your request or provide you personal information if we cannot verify your identity or authority.

We do not charge a fee. We could charge a reasonable fee or refuse to act on a request if the request is excessive, repetitive or manifestly unfounded.

If you are a California resident under age 18, and a registered user of any site where this Policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you publicly posted.

To make a request, please send an email with a detailed description of the specific content or information to info@sityo.com. Such request does not ensure complete or comprehensive removal of the content or information you posted and there are circumstances in which the law does not require or allow removal even if requested.

Under California law, California residents have the right to request in writing from a business with whom they have an established business relationship (1) a list of categories of personal information, such as name, address, e-mail address, and type of services provided to the customer, that a business disclosed to third parties (including affiliates that are separate entities) in the prior calendar year for the third parties' direct marketing purposes; and (2) names and addresses of all such third parties. To request this please write to us by mail or email. Our email and mail address are provided at the end of this policy. We will respond to requests within 30 days of receipt. We are only required to respond to each customer once per calendar year.

20. Nondiscrimination.

You have a right not to be discriminated against for exercising rights under this policy. We will not discriminate against you for exercising any rights described in this policy.

21. Exercise by Your Representative.

Rights described in this Policy that you may exercise, may be exercised by your authorized representative. We require proof that the representative is authorized by you. We anticipate that we will accept a form of authorization or permission provided and signed by the consumer authorizing the representative to act, together with verification of the consumer's identity or other direct confirmation from the consumer of having authorized the representative to act. Alternatively, we can accept a signed, notarized power of attorney appointing the representative.

22. Do-Not-Track Signals and Similar Mechanisms.

Some mobile web browsers transmit "do-not-track" signals. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

23. Interpretation.

These Policy terms are governed by and construed according to California law, without giving effect to conflict of law principles. Headings in this policy are for convenience to make the provisions easier to find. They shall not be used to interpret this Policy. This Policy must be interpreted according to fair meanings, and not strictly in favor of or strictly against you or us. This Policy is not a contractual obligation. We could deviate from this Policy whether due to inadvertence or in circumstances where we believe other considerations justify deviation.

24. Policy is Not for Benefit of Others.

In our relationship with you, this Policy is between you and us and not any other person or entity arising from the relation between you and us. The terms we enter into with or policies we apply to other persons or entities (even if the same as these provisions) are not for your benefit. We do not promise you that we will or can enforce our restrictions or prohibitions or any terms, against any other person or entity. YOU ASSUME THE RISK THAT OTHER PERSONS WILL VIOLATE OUR TERMS WHICH MAY OFFEND, DAMAGE AND/OR INJURE YOU.
